UK Will Advice Ltd, posted on Thursday 30 June 2022 It's now not about a diagnosis, it is a capacity report you need, he can have dementia but still have capacity, that is the important part to enable him to set up LPAs, if the dementia has set in too much and the capacity report says he does not have capacity he/you cannot set up LPAs, in stead at that point you will need to apply for deputyship (which can be very costly) https://www.gov.uk/become-deputy, either way you now need a capacity report before proceeding.
Christine Quinn, posted on Thursday 30 June 2022 Ok thank you hopefully I will be able to get back to you finger crossed also can I apply for deputy/ship myself saveing costs ? Through GOV.Com mrs Quinn

UK Will Advice Ltd, posted on Thursday 30 June 2022 You can apply yourself, however the deputyship goes through the courts and that is where the cost is, you cannot avoid that, it often is in the £1000s and there are annual fees to maintain the deputyship each year, just to prepare you.
Christine Quinn, posted on Thursday 30 June 2022 No way is there any thing else I can apply for instead of that it’s not fair we grandperents we are also bringing up two grandchildren age 9 14 how am I surpose to do this terrible ?

UK Will Advice Ltd, posted on Thursday 30 June 2022 Unfortunately not, there are no other options, as I said, depending on your fathers condition, you may be able to get a capacity report which will allow you to setup the LPAs before his condition degrades to far after which you require the deputyship.
  • Murria Solicitors, posted on Sunday 3 July 2022 As he has dementia, a mental capacity assessment will be required to confirm that he has capacity to make an LPA. If the mental capacity report confirms that he has capacity to make an LPA, we can arrange one for £295 plus VAT plus £82 Office of Public Guardian Registration Fee. Unfortunately, the quotation of £99 plus VAT does not sound realistic. Kind regards, Murria Solicitors
