Good afternoon.During exceptionally heavy rain, my property is flooded by water coming off the road and car parks. This happens because the storm drain covers become blocked by straw and other detritus washed down the roads. Highways/drainage,state that they are not responsible because the property has been developed after the road was built, and the runoff that used to be used is now blocked by a garage and driveway.The property is listed and part of the exterior cob wall, is being damaged by the flooding. The entire curtilage of the property is within 15m of a main river. Historically the floodwater was initially drained via a grey water drain into the septic tank,the residual water allowed to permeate into the ground. Both of these solutions are illegal and I have had to close the grey water drain and put in a sump and pump system to mitigate the illegal activities.I have begun litigation against the previous owners as they reported that the property did not flood on the TA6.Initially I require an informal assessment with a more permanent solution that can be presented to the defendant, hopefully to secure a negotiated settlement.
