At one time the use of “Professional” was restricted to the traditional professions, Doctors, Lawyers, Architects etc, but now it is used to describe anyone, or any organisation, that professes to possess the above average knowledge or skill on a given subject.

Anyone, therefore, who proffers advice, or undertakes designs etc, to or for the layman will be deemed a Professional and held liable if that advice, design etc is found not to achieve a reasonable standard of care (professional negligence). Even gratuitous negligent advice given by a Professional can create a liability and, perversely, a Professional who appears to be knowledgeable on a subject outside his profession, will be liable for that advice if they do not disclaim liability for the advice. An example is ourselves, being Insurance Brokers, giving advice on the Law, so can we here and now disclaim any liability for any legal advice given. A solicitor should be consulted on the Law, not an Insurance Broker.
